Attorney Daniel Hatch Update - Downtown Beautification Project Update
Village Attorney Daniel Hatch provided an update on the Dawntawn Beautification Project by reviewing the items listed in the Village’s Notice of Default and Direction to Cure sent to representatives of Wightman & Associates and Balkema Excavating, Inc. on July 15, 2025. This. notice included deficiencies originally noted by MDOT on April 16, 2025, which required correction to meet applicable State, Federal and industry standards. Mr. Hatch shared that after many months of inaction, Wightman has recently agreed to submit a revised plan to MDOT, and both entities have now agreed to fix the vast majority of the items at generally no additional cost to the Village. The Village will need to determine which businesses wish for downspouts to be connected and determine where the benches will be placed after Wightman and Balkema show exactly where they are proposing to place them, which is detailed in the newly submitted Plan.
The revised joint proposal from the contractors (dated October 24, 2025) addresses critical defects, including the installation of isolation joints around fixed objects and buildings, connection of downspouts to drainpipes (subject to business owner approval), and replacement of non-compliant curb ramps and single-step accessibility risers. The most significant point of contention remains the incomplete curb and gutter work at East Main St. and Burney St. The contractors offered to complete this work at no cost if the Village agrees to waive all claims for liquidated damages. Final work is contingent upon MDOT and Village approval of the submitted revised design plans.
A question was raised regarding the broken glass window at the Patch & Remington building. Attorney Hatch confirmed he would secure an assessment on the cost to Remove and Replace (R&R) the window. Additionally, staff was asked to contact the Village's insurance company regarding the window damage claim.
